1. Acceptance of Terms

By downloading, installing, or using the Neurona application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Neurona ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

Neurona is a wellness application that provides:

  • Real-time binaural beat generation
  • Solfeggio frequency tones
  • Isochronic tones
  • Ambient sound libraries
  • Pre-built soundscapes for sleep, focus, meditation, relaxation, and spiritual practices
  • Timer functionality with smart fade out
  • Optional Apple Health integration

Not a Medical Device

Important: Neurona is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The App is designed for general wellness purposes only.

The binaural beats and frequencies provided by Neurona should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before using any wellness application, especially if you:

  • Have epilepsy or a history of seizures
  • Have a heart condition or wear a pacemaker
  • Are pregnant
  • Have any psychiatric conditions
  • Are taking medication that affects brain activity

3. User Accounts

Age Requirement

You must be at least 13 years of age to use Neurona. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

Account Responsibility

If you create an account with Neurona, you are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate your account if we believe you have violated these Terms.

4. Subscriptions

Free Tier

Neurona offers a free tier with limited functionality, including access to select soundscapes, a 30-minute timer limit, and a limited ambient sound library.

Premium Subscription

Neurona Premium unlocks all features and content. Subscription options include:

  • Monthly: $4.99 per month
  • Yearly: $29.99 per year (approximately 50% savings)

Prices are in USD and may vary by region. Local taxes may apply.

Free Trial

New subscribers may be eligible for a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged.

Billing

Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to Premium features until the end of your paid period.

Refunds

All payments are processed through Apple. Refund requests must be submitted directly to Apple through their standard refund process. We do not have the ability to issue refunds directly.

5. Acceptable Use

You May

  • Use the App for personal, non-commercial wellness purposes
  • Create custom soundscapes for your own use
  • Share your positive experiences with others

You May Not

  • Reverse engineer, decompile, or disassemble the App
  • Copy, modify, or distribute the App or its content
  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Remove any copyright or proprietary notices
  • Use the App while operating vehicles or heavy machinery
  • Share your subscription with others
  • Resell or redistribute content from the App

6. Intellectual Property

All content in Neurona, including but not limited to:

  • Audio content (binaural beats, ambient sounds, soundscapes)
  • Visual design and user interface
  • Logos, trademarks, and brand elements
  • Software code and algorithms
  • Documentation and instructional content

is owned by Neurona or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to:

  • Sell, resell, or commercially exploit the App or its content
  • Copy or extract audio content for use outside the App
  • Modify or create derivative works

7. Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Medical Advice

Neurona does not provide medical advice. The information and content provided through the App is for general wellness purposes only and should not be considered medical advice. We make no claims regarding the effectiveness of binaural beats or other audio frequencies for any specific condition.

No Health Guarantees

We do not guarantee any specific health outcomes from using Neurona. Individual results may vary. The effectiveness of binaural beats and similar technologies varies from person to person.

Service Availability

We do not guarantee that the App will be available at all times or that it will be error-free. We may modify, suspend, or discontinue the App or any part of it at any time without notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL NEURONA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
  • OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
  • SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless Neurona and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify you through the App or via email for material changes
  • Give you an opportunity to review the new Terms before they take effect

Your continued use of the App after any changes indicates your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
